Rosemary Fisher is a partner at SimpsonWigle LAW An experienced trial lawyer, her preparation, common sense and keen understanding of the real business issues have earned her the respect of the courts and her peers. When necessary or advantageous to her clients, Rosemary will develop innovative alternate dispute resolution strategies.

In bankruptcy and insolvency matters, Rosemary provides advice to banks and small to medium sized businesses, including counsel for debtors, creditors and trustees in the context of proceedings, disputes and transactions under the Bankruptcy and Insolvency Act, the Companies’ Creditors Arrangement Act and related provincial legislation. She regularly advises on proposals, informal workouts, priority disputes, fraudulent transactions, reorganizations, asset recovery and receiverships. Rosemary has extensive knowledge of Personal Property Security and Bankruptcy Legislation and has written and lectured on the subject.

In commercial litigation Rosemary represents clients in matters ranging from individual business disputes and asset recovery, to hostile and complex matters, either in negotiated settlement or court action. She assists clients in recognizing what is at risk and how best to manage that risk. Rosemary represents clients regularly in Commercial Court and has appeared numerous times before the Appellate Court. She acts on behalf of large companies, financial institutions, trustees/receivers, sole proprietors, professionals and not for profit organizations.

Rosemary’s estate litigation experience includes dependent adult applications, dependent’s relief claims, mental incapacity, undue influence claims, Will challenges, breach of trust actions, interpretation and enforceability of Wills, and  the appointment or removal of trustees.
